Although recent scholarship has increasingly situated the Qur'ān in the historical context of Late Antiquity, such a perspective is only rarely accompanied by the kind of microstructural literary analysis routinely applied to the Bible. The present volume seeks to redress this lack of contact between literary and historical studies. Contributions to the first part of the volume address various general aspects of the Qur'an's political, economic, linguistic, and cultural context, while the second part contains a number of close readings of specific Qur'ānic passages in the light of Judeo-Christian tradition and ancient Arabic poetry, as well as discussions of the Qur'ān's internal chronology and transmission history. The Crimean Khanate was often treated as a semi-nomadic, watered-down version of the Golden Horde, or yet another vassal state of the Ottoman Empire. This book revises these views by exploring the Khanate's political and legal systems, which combined well organized and well developed institutions, which were rooted in different traditions (Golden Horde, Islamic and Ottoman). Drawing on a wide range of sources, including the Crimean court registers from the reign of Murad Giray (1678-1683), the book examines the role of the khan, members of his council and other officials in the Crimean political and judicial systems as well as the practice of the Crimean sharia court during the reign of Murad Giray.

Drawing on Hanafi fatawa and legal commentaries from Ottoman Syria between the 17th and early 19th centuries, this book examines the legal status of tenants and sharecroppers on arable lands, most of which were state or waqf properties. Challenging existing scholarship which argues that the status of cultivators gradually eroded after the 16th century, this study explores how jurists balanced the rights and obligations of tenants and landlords, thereby ensuring the adaptability of the Ottoman land system. The work addresses the differences between sharecropping and tenancy arrangements, the limitations that governed state and waqf officials, and the interplay between shariʿa and qanun in shaping land laws. The book also illustrates the doctrinal development of the law and sheds light on notions of 'ownership', ideas of private vs. public good, and prevailing conceptions of social and economic justice.

In Politics of Honor , Başak Tuğ examines moral and gender order through the glance of legal litigations and petitions in mid-eighteenth century Anatolia. By juxtaposing the Anatolian petitionary registers, subjects' petitions, and Ankara and Bursa court records, she analyzes the institutional framework of legal scrutiny of sexual order. Through a revisionist interpretation, Tuğ demonstrates that a more bureaucratized system of petitioning, a farther hierarchically organized judicial review mechanism, and a more centrally organized penal system of the mid-eighteenth century reinforced the existing mechanisms of social surveillance by the community and the co-existing "discretionary authority" of the Ottoman state over sexual crimes to overcome imperial anxieties about provincial "disorder".

A Political Economy of Lebanon, 1948-2002 : The Limits of Laissez-faire /

This book is about the laissez-faire strategy for economic development, a strategy inspired by neoclassical/mainstream economics, advocated by the "Washington Consensus", and implemented by the Bretton Woods institutions. Mainstream economics has taken legitimacy from the historical failure of command economies. But this view has not been balanced by an examination of the performance of laissez-faire economies, the closest to the pure market model. Lebanon provides a unique test case in this regard. The book assesses Lebanon's development during 1948-2002, including its industrial and financial performance. The dynamics of the laissez-faire system is separately studied from a Post-Keynesian perspective, highlighting institutional behavior. It is found that laissez-faire is not a sufficient condition for economic development, and can even be counterproductive.

Condensing research concerning questions of religion which encompass the social history of ideas and the religious uses of language, this book deals with three questions: the relationship of the Mishnah to Scripture, the relationship of the religious ideas people hold to the world in which they live, and the religious meaning of the formalization of language that characterizes the Mishnah in particular. In discussing how the Mishnah relates to Scripture - in the (later) mythic language of Rabbinic Judaism: \'the oral Torah\' to \'the written Torah\' - a complete analysis is presented, based on a systematic application of a single taxonomic program. Then an examination is made of how the stages in the unfolding of the Halakhah of the Mishnah relate to the principal events of the times, which delineate those stages. Here focus is given to those pre-70 C.E. components of the Halakhah that later come to the surface in the Mishnah, but discussion extends to the periods from the destruction of the Temple in 70 C.E. to the Bar Kokhba War, concluded in circa 135 C.E., then from the reconstruction, 135 C.E., to the closure of the Mishnah, 200 C.E. Finally attention is given to methods of interpreting the rhetorical forms of the Mishnah in the context of the social culture laid bare by the socio-linguistics of the documents concerned. In medieval Persia, the munshī or court secretary belonged to a highly professional, privileged class, enjoying a comfortable income and attractive living conditions. The better one's style of writing, elegant yet concise, and the more types of document one could draft, in each case using the appropriate format and terminology, combined with the right kind of political intelligence, the higher one would rise in munshī hierarchy. Despite his high social standing, a munshī could find himself without a job overnight if he fell victim to court intrigue or if there was a change in power. The author of the universal history contained in the present volume, Būdāq Munshī Qazwīnī (d. late 10th/16th cent.), who in his lifetime worked as a scribe, secretary, local administrator, assessor, controller, and vizier, lost his job several times precisely for these reasons. This study examines the role of the state in the construction of knowledge in Islamic civilization in its early classical period (third/ninth and fourth/tenth centuries). Different voices representing different social groups - savants, littérateurs, religious scholars, state officials - all brought their particular conception of knowledge to bear on the formation of the various branches of knowledge known to Islamic civilization. Reading the works of various branches of knowledge alongside the administrative encyclopedia of Qudāma b. Ja'far (d. 337/948), a state official in the employ of the Abbasid dynasty, has served to highlight the particular point of view of the state in the intellectual and cultural dialogue of the day. The German Assyriologist Fritz Rudolf Kraus was an academic emigrant who was forced to leave Germany during the Nazi period. Kraus spent thirteen years in exile in Istanbul, where he was appointed cataloguer at the Archaeological Museum. During his exile he kept in touch with his family in Germany and with colleagues, in particular his former teacher, Benno Landsberger, who had moved to Ankara in 1935. The selection of his voluminous correspondence presented in this work is an important source for the history of both Turkey and Germany during the years 1937 to 1950. Der deutsche Assyriologe Fritz Rudolf Kraus war ein Wissenschaftler, der Deutschland während der Nazizeit gezwungenermaßen verlassen musste.
